Double Fusion Inc. (hereinafter referred to as “Double Fusion” or “we”) respects the privacy of game players and online visitors and recognizes the importance of protecting personally identifiable information when you use video games (“Games”) powered by Double Fusion’s in-game advertising services (collectively, the “Services”). The Privacy Policy is designed to assist you in understanding how we collect, use, and safeguard the personal information you provide to us, and to assist you in making informed decisions when using our Services. This statement will be continuously assessed against new technologies, business practices and our visitors’ needs. Please note that specific privacy policies with respect to your use of Games powered by Double Fusion’s in-game advertising services may be modified on a Game-by-Game basis and set forth in the respective end user license agreements. In addition, please note that this Privacy Policy shall also apply to our web sites (collectively, the “Site”) which shall be deemed to be part of the Services, except as otherwise specified herein (e.g., with respect to cookies and children’s privacy).

WHAT INFORMATION IS COLLECTED?

Personally Identifiable Information

Personally identifiable information is any data that can be used to identify, contact or locate a particular person. Examples of such information include name, address, telephone number and email address. In the course of your use of our Services, unless you voluntarily provide us personally identifiable information, we do not collect any personally identifiable information.

We ONLY gather personally identifiable information through our Services when and where you volunteer to provide it. For example, if you submit your resume, request investor information, or sign up for our e-mail notification service, we will ask you to provide your name, address, e-mail address, phone number, facsimile number and any other information you provide to us in your resume or cover letter. If you choose not to provide such information to us, we will not be able to provide you with the information that you may want or consider you for a position at Double Fusion, as the case may be.

We may ask people to register and provide personally identifiable data through our Services. Double Fusion is committed to making sure that clear notice and choice is provided to all Service users before the personally identifiable data is collected, and that they have opted-in to our use of their data. Service users who have provided personally identifiable data may elect to have their data deleted from our files, or kept from being used for purposes other than for the Service requested, by following the Opt-Out procedures set forth below.

Non-Personally Identifiable Information

We may, however, collect non-personally identifiable (i.e., anonymous) information about you, such as the server into which your computer is logged, or your browser type.

COOKIES:

Certain sections of the Site or Services may use "cookies." Cookies are very small data files left on your computer by the Site or Services. These files can then be accessed by the Site or Services in the future. Most browsers are automatically set to accept cookies. Our use of cookies does not contain or collect any personally identifiable information.

We may use web site browser software tools such as cookies and web server logs to gather information about our Site users' or Game players browsing or viewing activities in order to constantly improve our Services and better serve our visitors, the Game players and Business Partners (as defined below). This information assists us in designing and arranging our Site and/or Services in the most user-friendly manner, and in continually improving our Site and/or Service to better meet the needs of our visitors, prospective visitors, Game players and Business Partners. While Double Fusion has rights to the data we collect and store, we do not sell or transfer this data except to our Business Partners as described below. You may opt-out of the use of Double Fusion’s cookies on the Site by following simple procedures to manually delete your cookies and disable cookies on your browser. You should refer to your browser’s user manual for instructions on taking such actions.


BEACONS:

Certain sections of the Services may use “web beacons.” A web beacon or clear GIF or pixel tag is a line of code that allow us to access cookies and to help us track marketing campaigns and the general usage patterns of with respect to advertisements.

When you click on or view an advertiser's ad through our Services, if we have used a web beacon, the advertisement will contain a clear GIF or pixel tag that is not visible on the screen. A GIF is a type of graphic that often appears invisible because it is only 1x1 pixel in size. In these instances, GIFs are represented by HTML tags. The HTML tag is programmed to collect certain anonymous information about the surfer's visit to the website or ad. This non-personally identifiable information is then sent to Double Fusion’s Services and may be shared with Double Fusion’s Business Partners as described below.


INFORMATION USAGE AND DISTRIBUTION:

The non-personally identifiable data that we collect are used for marketing and sales efforts to better target advertisements to Game players and online visitors. We may also use the non-personally identifiable data to better target content to individuals in an effort to create a personally relevant experience for each person. The data is also used to predict responses to advertisements, and to help determine which ads perform best and which content is most appropriate for different individuals.

If a Game player or online visitor elects to provide us with personally identifiable data, we may utilize such data for marketing purposes. In addition, that data may be combined with information collected from other sources to assist with targeting ads to that game player’s or online visitor’s preferences and behaviors, and for other Double Fusion sales and marketing efforts.

Broadly speaking, we use personally identifiable information (which we have gathered with your consent) for purposes of administering our business activities and making available other products and services to our visitors and prospective visitors. Occasionally, we may also use the information we collect to notify you about important changes to our Services, new Services, and special offers we think you will find valuable. The lists used to send you product and service offers are developed and managed under our standards and those of our service provider, which are designed to safeguard the security and privacy of our visitors’ personally identifiable information.

Sharing Information

In accordance with this Privacy Policy we may share the non-personal information collected by our Services, i.e., information collected from the Games that connect to our servers, with our advertisers, advertising agencies, and Game publisher and developer licensors and licensees (collectively, “Business Partners”). Furthermore only in accordance with this Privacy Policy and the terms of your consent will we share any personal information that you have voluntarily given to us with our Business Partners. We may also share aggregate information about our systems with our auditors and providers of technology or services upon which we rely to deliver our Services. From time to time, we may publish or report aggregate statistics related to our business. When we report or publish such statistics, we do not include or reveal any information specific to Game players.

The anonymous information that we collect on behalf of our Business Partners is useful only to the specific Business Partner who employs us to deliver advertising, and generally only in the context of our selection of advertising content, reporting of advertising effectiveness and billing. In order to assess an advertising campaign's effectiveness, our Business Partners may hire us to report to them our analysis of the anonymous data in a summarized format. On occasion, our Business Partners ask us to share with them, or their agents, data that is collected through specific video games. In these situations, we share only anonymous data. We recommend that you review the privacy policies and end-user license agreements associated with the Games you play and contact game publishers and/or game developers directly if you have questions about their information practices. Some of our Business Partners, or their agents, might receive anonymous information relating to game play from us. Our Business Partners typically warrant that the information they receive shall be used in compliance with applicable laws. We may also disclose certain information in response to subpoenas, court orders or legal process. We may purge from our databases any information (whether personally identifiable or non-personally identifiable) about users of our Services without notice to any user.

We do not have the ability to prevent our Business Partners, or game console manufacturers, from collecting personally identifiable information about game players using their own means. They may do this, without our knowledge, through games and consoles that are enabled with Internet connectivity. Accordingly, we encourage you always to read the privacy policies and end-user license agreements associated with the Games you play, and the game consoles you purchase, to understand issues relating to your privacy rights when using these products.

Subject to the scope of your consent, we may also share personally identifiable information with other third parties who enter into business relationships with us, including financial service providers (including credit bureaus and insurance agents); non-financial companies (including retailers, online and offline advertisers, membership list vendors, direct marketers and publishers); companies that perform marketing services on our behalf, and others such as non-profit organizations.

Transfer of Business Assets

In the event that Double Fusion undergoes a change of control or is sold or transferred, or in the event that substantially all of its assets are sold or transferred to a third party, the Services and any non-personal or personally identifiable information collected by Double Fusion, will be among the transferred assets. By using our Services, you hereby agree and consent to such transfer or assignment of your non-personal and personal information collected by Double Fusion or to a change of control of Double Fusion, and you further waive any claims that could be made against us in relation thereto.


DATA SECURITY:

Double Fusion makes significant efforts to maintain the security of its network and the information we collect. We use various technologies, including, in certain instances, encryption, to ensure high security standards. Any data that is stored on our servers is treated as confidential and is not generally available to the public. Our employees are made aware of and are accountable for compliance with our Privacy Policy, and access to personally identifiable information will be limited to only those employees who we reasonably believe need to know such information for the purpose of performing their jobs. Please keep in mind, however, that the Internet is not a 100% secure medium. Therefore, although we use reasonable efforts to protect information, the possibility of somebody defeating our security measures does exist.


CONSUMER CHOICE:

Access to Data

We allow users who have provided personally identifiable information access to their information to ensure that it is correct and to make any changes and/or delete such information. Please contact us at support@doublefusion.com.

Personally Identifiable Information Opt-Out

If you elect to provide us with personally identifiable information through the Services, you have the right to tell us not to make some of the uses of such information described in this Privacy Policy, or may have such information deleted in its entirety. Simply contact us at support@doublefusion.com and provide the name of the Service for which you provided information and let us know what level of opt-out you would like to exercise. These include: (1) Do not share information about me with Business Partners, (2) Do not solicit me with special offers other than those related to the Service I signed up for, (3) Remove my data from your database for such Service completely. Once we receive this instruction, we will promptly take corrective action. Please note that we will need you to provide your email address or other previously provided personal identifier in order to identify you in the Opt-Out process. Also, please remember that if you choose to delete your information completely you will no longer receive the Double Fusion Service in question.

CHILDREN’S PRIVACY:

The Site complies with the U.S. Children’s Online Privacy Protection Act.

Children under the age of 13

Because the Site is not directed to children under the age of 13, Double Fusion does not provide memberships or registration to persons under age 13. If you are under the age of 13, you may not create an account on the Site, you may not sign up for any subscription service or buy anything through the Site, and you are not eligible to enter any of Double Fusion’s sweepstakes or promotions. Except as may be required by law, Double Fusion will not knowingly collect, maintain, or disclose any personal information from children under the age of 13.

Children between the ages of 13 and 18

If you are between the ages of 13 and 18, please let your parent or guardian know about this Privacy Policy and get his or her permission before you give us any of your personal identifiable information, before you use any of our message board, instant message or chat features, before you sign up for any subscription game services, and before you buy anything from the Site. Do not post your real name on a web site or message board, and never tell anyone online anything private about yourself or your family, including your phone number and address. Use screen names at all times. If you win a sweepstakes that has a prize, your parent or guardian will have to mail or fax us a signed note at the address or fax number listed in the rules for the specific contest that says it was OK for you to enter, and tells us they will accept the prize for you. Some areas of the Site may have special rules for children under the age of 18. When you are in those areas, you must follow those rules.

Information for Parents/Guardians

Double Fusion encourages parents and guardians to spend time online with their children to become familiar with the types of content available on the internet. Parents and guardians should regularly oversee their children's use of e-mail and other online communications and transactional features. Control tools are available from online services and software manufacturers that can help provide a safe online environment for kids.

If you are a parent or guardian who has discovered that your child has submitted his or her personal information without your permission or consent, we will take reasonable steps to promptly remove that information from our database at your request. To request removal of your child's information, please send an e-mail to support@doublefusion.com and be sure to include in your message the same user name, password, and email address that your child submitted.


LINKS TO THIRD PARTY SITES:

The Site or advertisements through the Service or the Games themselves may from time to time contain links to third-party web sites. Double Fusion is not responsible for the privacy practices or the content of such web sites. If you are concerned about the privacy policy of a certain third party, you may contact them directly or visit their individual web sites to learn more about their individual privacy policies.


CHANGES TO OUR PRIVACY POLICY:

The issue of privacy is an evolving one. We are committed to the constant monitoring and examination of our privacy practices, and may, from time to time, institute changes to our Privacy Policy. In the event that any material changes are made to our privacy practices, we will promptly make changes to this Privacy Policy that discloses such changes.
